Digital Services Act notice
In short
- Report content you think is illegal with the report button, the public notice form (no account needed) or by email to To be confirmed.
- We confirm receipt at once, a person reviews it, and we tell you what we decided.
- If we remove content or restrict an account, we send a statement of reasons and you can complain, go to an out-of-court body or to a court.
- Every professional on the marketplace has a public business section with name, address and registration number.
- Our contact points and our legal representative in the EU are listed below.
MovItaly lets users publish content, for example forum posts, replies and messages. This page explains how to report illegal content, how we decide, and how to challenge a decision. It follows Regulation (EU) 2022/2065, the Digital Services Act (DSA).
Contact points for authorities and users
Authorities of the Member States, the European Commission and the European Board for Digital Services can reach us through one single point of contact (Article 11): To be confirmed. Users can use the same address (Article 12) for direct and fast contact about content and decisions. You can write to us in English or Italian. This is not an automated-only channel: a person reads every message. For post, use To be confirmed.
Legal representative in the EU
Lodato Solutions LLC is established in Delaware, USA, and offers the service to people in the EU. As Article 13 requires, we have named a legal representative in the Union: To be confirmed, To be confirmed, To be confirmed. Authorities may address the representative in addition to, or instead of, us for any matter under the DSA. The representative can be held liable for breaches, without limiting our own liability.
How to report illegal content (notice and action)
Anyone can tell us about content they think is illegal (Article 16). In the app, use the report button on a forum topic, a reply, a message, a professional profile, a booking, a news item or a user. You can also write to To be confirmed.
Your notice should contain:
- The reasons why you believe the content is illegal, with the law you think it breaks if you know it.
- The exact location of the content, for example the web address, or the topic and reply you reported.
- Your name and email address. You do not have to give them for content about child sexual abuse.
- A statement that you believe in good faith that the notice is accurate and complete.
The public notice form needs no account. Choose one category: illegal content, breach of our rules, counterfeit goods, scam, child safety, copyright or other. When you send it you get a reference number straight away, and you can check its status with that number. The same form is used for rights holders who ask us to remove infringing material.
After you send a notice we confirm receipt without undue delay. We then review the content with care, objectively and without bias, and tell you what we decided and what redress you have.
Statement of reasons
When we remove or disable content, suspend or end an account, or restrict a feature because the content is illegal or against our rules, we send the affected user a statement of reasons (Article 17). It says what we did, whether it covers content, a feature, payments or the account, the facts and circumstances we relied on, whether the decision came from a notice or from our own check, whether we used automated means, the legal ground or the rule of our terms we applied and why, and how to challenge the decision (internal complaint, out-of-court body, court). Each statement is stored with its date and is sent in the language of your account. We send it when we act, unless the law or an authority stops us from telling you. The report categories we use are spam, harassment, inappropriate content, scam, child safety and other.
Information about professionals on the marketplace
Professionals who offer services in MovItaly act as traders. Before a profile is approved, we collect and check the trader details: legal name, address, business email and phone, VAT or registration number, a payment account verified by our payment provider, and a statement from the professional that they offer only services that comply with the law. We make reasonable efforts to check that this information is reliable. The public section of each profile, which you can also read at the web address /dsa/traders/{professional id} of our API, shows the name, address, registration number and the one contact the professional chose to publish. Their account email and phone number are never shown. Keep in mind that a professional is independent from us: the contract for a service is between you and the professional.
Our size and which duties apply
Some duties of the Digital Services Act for online platforms (Articles 19 to 28) do not apply to micro and small enterprises, which are those with fewer than 50 staff and a turnover or balance sheet of up to EUR 10 million. Our own check of this is written down, and its status is: pending owner signature. Until it is signed and counsel has confirmed it, we do not rely on the exemption in practice. We already apply notice and action, statements of reasons, internal complaints, the "Sponsored" label and the protection of minors as described on this page, and we will change this section if our size or the law changes.
Internal complaint handling
If you disagree with a decision, you can complain to us for at least six months after you receive the decision (Article 20). This applies to the person who sent a notice and to the user whose content or account was affected. Write to To be confirmed and quote the reference in our message. A different member of the team than the one who took the decision reviews the complaint, under qualified human supervision. We answer in a timely, non-discriminatory and diligent way, and we undo the decision if it was wrong.
Out-of-court dispute settlement
You may also take a decision to a certified out-of-court dispute settlement body (Article 21). The body must be certified by the Digital Services Coordinator of a Member State. For Italy this is the Autorita per le Garanzie nelle Comunicazioni (AGCOM). We will take part in good faith. The body's decision is not binding on you, and this does not take away your right to go to court. We will list the certified bodies here when counsel confirms them. At the moment no body is listed. Until then you can still write to us, to AGCOM or to a court.
Trusted flaggers
Notices from trusted flaggers, organisations that the Digital Services Coordinator has awarded that status (Article 22), get priority and are decided without undue delay. A trusted flagger should write to To be confirmed and say that it holds the status. We do not award the status ourselves, and we do not rank other notices by who sent them.
Misuse and repeat offenders
We may suspend, for a reasonable period and after a prior warning, users who often post manifestly illegal content, and people who often send notices or complaints that are manifestly unfounded (Article 23). We look at how often it happens, how serious it is, and what the person meant to do. Child-safety reports are handled first. Account bans are applied by our admins and recorded in an audit log.
Transparency and minors
We keep records of notices and decisions so that we can report on them. Where the law applies to us, we publish a yearly transparency report on content moderation. We do not show advertising based on profiling, and we do not use any ad tracking, none at all for minors. Minors from 14 to 17 use the service with a guardian's consent, and people under 14 cannot register. See the community rules and the privacy policy.
